Task Force on Judicial Foreclosure Rules

On September 20, 2007, the Supreme Court of Texas issued an order [pdf] appointing a Task Force on Judicial Foreclosure Rules to review Rule 735 and Rule 736 and to present to the Court any recommended amendments to those rules.

Rules 735 and 736 of the Texas Rules of Civil Procedure were intended to address judicial foreclosure of home equity loans and reverse mortgage loans. Recent legislative enactments, however, appear to warrant further review of the procedures established in those rules.

Mr. W. Mike Baggett of Winstead, Sechrest & Minick chairs the Task Force. Justice Phil Johnson serves as the Texas Supreme Court's liaison.
